By using Orbit ("the App"), provided by Imori Studio ("we", "us", "our"), you agree to be bound by these Terms of Service. Please read them carefully.
1. Use of the App
Orbit is designed as a personal diary and emotional tracking tool. You are responsible for all activity that occurs under your account. You agree to use the App only for lawful purposes.
2. Account Registration
- You must provide accurate information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must be at least 16 years old (or the minimum age required in your country) to use Orbit.
3. Privacy and Data
Your use of the App is also governed by our Privacy Policy. Since Orbit handles sensitive emotional data, you acknowledge and agree to the collection and processing of such data as described in the Privacy Policy.
4. Premium Subscription (Orbit Premium)
Certain features (e.g., advanced customization, specialized visual styles) require a paid subscription.
- Subscription Details: Orbit offers monthly and annual subscription plans. The price and duration are displayed clearly within the App before purchase.
- Payment and Renewal: Payment will be charged to your iTunes Account or Google Play Account at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Billing: Your account will be charged for renewal within 24 hours prior to the end of the current period, identifying the cost of the renewal.
- Management and Cancellation: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on the App Store or Google Play Store after purchase. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.
5. Intellectual Property
- Our Content: All software, design, and branding of Orbit are the property of Imori Studio.
- Your Content: You retain ownership of the data, text, and drawings you enter into the App. By using the App, you grant us a limited license to store and synchronize this content on our servers for the sole purpose of providing the service to you.
6. Prohibited Conduct
You agree NOT to:
- Reverse engineer or attempt to extract the source code of the App.
- Use the App to store or transmit illegal or harmful content.
- Interfere with the security-related features of the App.
7. Termination
We reserve the right to suspend or terminate your account if you violate these terms or for any other reason at our discretion, with or without notice.
8. Disclaimer of Warranties
Orbit is provided "as is" and "as available". We do not guarantee that the App will be error-free or uninterrupted. The App is for personal reflection and tracking; it is not a substitute for professional mental health advice or therapy.
9. Limitation of Liability
To the maximum extent permitted by law, Imori Studio shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the App.
10. Governing Law
These terms are governed by the laws of Italy (or your country of residence if required by consumer protection laws).
11. Apple App Store Supplemental Terms
If you have downloaded Orbit from the Apple App Store, the following terms also apply:
- Acknowledgment: You acknowledge that these Terms are between you and Imori Studio only, and not with Apple. Imori Studio, not Apple, is solely responsible for the App and its content.
- Scope of License: The license granted to you for the App is a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.
- Maintenance and Support: Imori Studio is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
- Product Claims: You acknowledge that Imori Studio, not Apple, is responsible for addressing any claims of the user or any third party relating to the App or the user’s possession and/or use of that App.
- Intellectual Property Rights: You acknowledge that, in the event of any third-party claim that the App or your possession and use of that App infringes that third party’s intellectual property rights, Imori Studio, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
